STAR WARS! AstroloGeeks sues NCGR for 10 counts of Breach of Contract!

June 5th 2019, AstroloGeeks Inc and the National Council for Geocosmic Research Inc (“NCGR”) entered into a contract for website development services provided by AstroloGeeks to NCGR. From the beginning, NCGR’s contract did not outline their scope of work correctly, as admitted by NCGR member Meira Epstein on recorded video.

On August 28th – September 1st, NCGR treasurer Linda Wilk demanded AstroloGeeks to completely halt and undo website development three times. A single move that in itself is considered two types of breaches of contract. Anticipatory Breach and Material Breach.

Then, between the dates of September 1st 2019 and February 28th 2020, NCGR not only refused to pay to close the contract they knowingly breached, they continued to breach the agreement by putting countless demands of work that were not in the agreement on AstroloGeeks, and then refused to pay for the work saying “they needed approval” in direct breach of agreement.

On March 4th 2020, AstroloGeeks Inc executed a Material Breach of Contract Notice of Lawsuit against National Council for Geocosmic Research Inc (“NCGR”) for 9 counts of Material Breach of Contract. You can view the legal notice here.

On Friday March 6th 2020, NCGR initially responded to the claim notice offering to settle $1,500.00 for the final amount owed on the agreement. AstroloGeeks declined the settlement agreement claiming that NCGR is refusing to pay for invoiced work demanded outside the scope of agreement, which in itself is considered a breach of contract. AstroloGeeks gave NCGR notice until March 9th 2020 to pay the outstanding invoices before beginning Arbitration Litigation Lawsuit.

On Sunday, March 8th 2020, NCGR offered to settle the lawsuit claim for $2,000.00. AstroloGeeks declined the settlement agreement claiming that NCGR is refusing to pay for invoiced work demanded outside the scope of agreement, which in itself is considered a breach of contract. AstroloGeeks declared it would accept no less than $3,500 out of the outstanding $5,500 owed by NCGR. NCGR tried asserting falsely that the invoice for work performed outside the scope of agreement was within the agreement.

NCGR was then served a final notice of lawsuit by AstroloGeeks for 1 count of anticipatory breach of contract because NCGR asserted over email that it never intended to fulfill the agreement by stating “the old website has to be running smoothly for our [Baltimore] conference” and timing their conference to fall on the date the contract was supposed to end, and then demanding the contract work be halted, which also doubles as a single count of material breach. It is Now March 9th, 2020 and AstroloGeeks Inc has officially filed Arbitration Litigation and provided every single email, text message and recording of evidence to the arbitrator. AstroloGeeks is asserting there are 10 total breaches of agreement, as well as unpaid work that is both within and not within the agreement. AstroloGeeks is claiming damages, litigation fees, and interest for the unpaid work. NCGR has 10 days to respond to the arbitrator and pay the arbitration fees before arbitration continues without them and a judgment is entered.
