AstroloGeeks prevails in arbitration claims against NCGR
On September 9th 2020, AstroloGeeks was awarded in all arbitration claims made against the National Council for Geocosmic Research (“NCGR”) for a dispute over a website development contract, which was signed and executed on June 6th, 2019.
The CEO, creator, and owner of AstroloGeeks (Joseph Milnes) was the sole developer of the 2019 geocosmic.org website that NCGR requested. AstroloGeeks does not usually offer website development services, so this agreement between AstroloGeeks and NCGR was a special agreement between the two corporations. Joseph Milnes was first contacted on or around April 19th, 2019 by NCGR board member Michael Bartlett with regard to web site development services.
Before entering the agreement, NCGR did not disclose to Milnes some important facts about the condition of their existing website, and fraudulently misrepresented their board of officers. NCGR concealed the following material facts about their existing website, including (but not limited to):
-past cybersecurity breaches
-the fact they were operating a multisite (rather than a single site) and the number of domains integrated into the multisite
-how many servers their multisite operated on, and the hosting providers of the numerous servers that were hosting the multisite.
– database bugs and types of databases that were not website related.
On Aug. 27th, Milnes completed the initial offline build of the site, within the terms of the contract, and was ready to begin configuring and setting up the site. It was at this point that the first material breach of contract was made by NCGR.
The organization (including NCGR Treasurer Linda Wilk) demanded that (as their Baltimore Conference was being held) the new site be put on complete hold for 30 days, and that the old site would need to remain functional for the time being (given its financial utility). Milnes tried to uphold the obligations under the contract while working with Bartlett, despite the fact that there was no amendment to the contract
Linda Wilk harassed Milnes via telephone very late at night yelling at him demanding that all progress be undone and to halt anything further for 30 days. The dispute began when NCGR refused to pay for egregious work demands outside the scope of the agreement and engaged in defamation against AstroloGeeks in order to hurt Milnes and his business.
NCGR engaged in several civil crimes and were found guilty on all five claims through arbitration with the Arbitration Association of America. The claims AstroloGeeks asserted are as follows:
- Material Breach of Contract
- Unjust Enrichment
- Fraudulent Misrepresentation
- Slander
- Evidence Tampering
Nonetheless, Astrologeeks has been awarded all its claims against NCGR. More details will be disclosed in an upcoming podcast. We are glad Michael Bartlett was a moral person, as he not only stepped down from the organization, but willingly testified against them, as his testimony was devastating to NCGR’s defense.
To date, NCGR has paid less than half of the settlement. We look forward to receiving the remaining balance, and trust that NCGR will govern themselves accordingly.
